Müdâyene Ayetinin Roma ve Türk Borçlar Hukuku Açısından Yorumu

The Quran, sent as a guide to humanity, has brought a number of regulations in the commercial field as well as in all areas of life. In this sense, the verse, which regulates all kinds of mutual debt futures in detail, has also put some provisions on cash purchases. Before proceeding with the legal provisions introduced, a brief overview of the verse, name, reason of reason, sika-sibakı, views of the verse and its important concepts was made, then the provisions in the verse, especially in the context of today's Turkish Code of Obligations and the Roman Law of Obligations, by using the sources and works of today's authors, their comments on current law are tried to be conveyed. In particular, the present effects of today's commercial life by making some comparisons of the verses in accordance with the laws in force in Turkey have been examined in the article limits.

İnsanlığa rehber olarak gönderilen Kur’ân-ı Kerîm, hayatın her alanında olduğu gibi ticari alanda da bir takım düzenlemeler getirmiştir. Bu anlamda karşılıklı borç doğuran her türlü vadeli işlemleri ayrıntılı olarak düzenleyen müdâyene ayeti aynı zamanda peşin alışverişler konusunda da bazı hükümler koymuştur. Getirilen hukuki hükümlere geçmeden önce ayetin meâli, ismi, nüzûl sebebi, siyak-sibakı, neshine dair görüşleri ve önemli kavramlarının kısaca genel bir tanıtımı yapılmış, daha sonra ayette geçen hükümleri, özellikle günümüz Türk Borçlar Hukuku ve ona kaynaklık eden Roma Borçlar Hukuku bağlamında klasik tefsir kaynakları ve günümüz yazarlarının eserlerinden istifade edilerek onların güncel hukuka dair yorumları aktarılmaya çalışılmıştır. Özellikle de günümüz Türkiye’sinde yürürlükte bulunan kanunlar çerçevesinde bazı mukayeseler yapmak suretiyle ayetin günümüz ticari hayatına etkileri makale sınırları içinde incelenmeye çalışılmıştır
