Minority before the age of appeal, like madness, is mere helplessness. Smallness is considered one of the states that come from the sky (from Allah) without the will and achievements of a person, narrowing or eliminating the capacity to act. The Fuqaha (ra) agreed that their dispositions would not be permissible because the child who did not reach the age of appeal, due to his lack of capacity to act, but they disagreed in two opinions about the dispositions of the child who has reached the age of appeal and the sane man who has reached the age of puberty, regarding the rights of the servant.
