The Evaluation of Hadiths That Judges Should Be Fair to the Parties When They Act as Arbitrators

Abstract

Justice is a universal rule of law. It has been the only measure sought for the continuity of order and order throughout human history. Considering the importance that Islam attaches to justice, justice has been emphasized repeatedly in the Holy Qur'an and hadiths. Because with justice, the difference between the righteous and the unrighteous is revealed. The most important authority that will realize the functioning of the justice system, which has a great impact on almost every stage of life, is undoubtedly the judges. While there have been studies on the institution of judgeship and the judicial system in many fields such as Islamic law, law, history, etc., there is no study in the field of hadith that examines the hadiths on the need for judges to be just while ruling. In order to contribute to this gap in the field of hadith, the hadiths on the fairness of judges are analyzed. Relevant hadith sources, especially the Qur'anic Sitteh, have been scanned on the issue of judges ruling justly. Arabic language dictionaries were consulted for the explanation of the words that are ambiguous, strange and closed in meaning. In this study, six hadiths were analyzed and evaluated on the principle that judges should approach both sides in accordance with the principle of justice when they act as arbitrators. Four of these hadiths are hadiths in which the words "judge" and "judgment" are directly used. The other two hadiths are hadiths that are quoted as examples about the issues that judges should pay attention to during the trial. To the extent that these hadiths can be found, comparisons have been tried to be made with the current law. The equivalents of these hadiths in the current law have been analyzed. In the analysis of the hadiths, three or four narrators from the muntehās of the hadiths were analyzed. While evaluating the hadiths, the evaluations of hadith critics, commentators and Islamic law scholars were utilized.
